These Terms of Service ("Terms") govern your use of the Sollingual website and services. Sollingual is a product operated by NorfBay LLC ("Sollingual," "we," "us," or "our"). By using our website or services, you agree to these Terms.
Sollingual is one brand with a Call Center product and a Lead Generation product, and you may use either or both. The Call Center (offered as After Hours or 24/7) is our bilingual call-answering and lead-handling service that picks up your calls, texts, and web chat, then books, routes, and documents them according to the configuration you approve. Lead Generation is our bilingual outbound campaign service that contacts your own past customers and unsold estimates by text and call on your behalf. Both combine technology with trained people. In both cases, the technology answers and reaches out, and your own team decides how to respond and close.
You must be at least 18 years old and authorized to act for your business to use our services. You are responsible for the accuracy of the information you provide and for activity under your account.
If you opt in to receive text messages from us, message and data rates may apply and message frequency varies. You can opt out at any time by replying STOP, or reply HELP for assistance. Our handling of mobile information is described in our Privacy Policy.
Paid plans are billed as described at the time of purchase. Call Center plans (After Hours and 24/7) are recurring monthly fees, and their setup fees are one-time. The Lead Generation plan is a recurring monthly fee that includes five campaigns each month, each reaching up to 500 customers, reset monthly and not carried over, plus one free campaign at onboarding. Additional campaigns are charged per campaign or in packs as described at the time of purchase. Your customer list is never charged per contact. Unless stated otherwise, fees are recurring, and setup fees are one-time. Taxes may apply.
Standard Call Center plans include unlimited calls, text messages, and web chat for ordinary inbound business use on the phone lines and channels you publish to your own customers. Standard Lead Generation use covers fair outbound campaign use to your own past customers and unsold estimates. Unlimited and standard use is meant for a normal business operating in good faith. It does not cover automated, resold, fraudulent, or abusive traffic, or use that is designed to burden the service beyond ordinary business volumes.
If an account's sustained usage materially exceeds the volumes typical of standard plans, we may move that account to Enterprise pricing. We will give you at least 30 days written notice before any such change takes effect, and you may cancel before it applies. We will always tell you before you reach that point.
We work to keep the services reliable but do not guarantee uninterrupted or error-free operation. We may modify or discontinue features with reasonable notice where practical.
The website, software, and content are owned by NorfBay LLC or its licensors. You receive a limited, non-exclusive right to use the services under these Terms.
The services are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.
To the maximum extent permitted by law, NorfBay LLC will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or revenues, arising from your use of the services. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.
You agree to indemnify and hold harmless NorfBay LLC from claims arising out of your use of the services or your violation of these Terms or applicable law, including claims relating to consents for calls or messages directed to your customers.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California.
We may update these Terms from time to time. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
